Melissa Gilbert Emotional as Court Grants Pretrial Release to Timothy Busfield

Melissa Gilbert was visibly emotional inside a New Mexico courtroom as a judge ruled on the custody status of her husband, Timothy Busfield. The court determined that Busfield would be released ahead of trial under strict conditions, approving release on his own recognizance. The decision requires him to appear at all future court dates and fully comply with court-ordered supervision requirements.

The ruling came after prosecutors requested that Busfield remain in custody, citing concerns related to the allegations and his past conduct. As the judge delivered the decision, observers noted Gilbert’s emotional reaction in the courtroom. Under the terms of release, Busfield will be monitored by pretrial services and must adhere to multiple restrictions, including abstaining from alcohol, controlled substances, and firearms. He is also prohibited from contacting potential witnesses and must notify the court of any change in residence. A trial date has not yet been set.

During the hearing, the judge explained that supervised release was appropriate based on the totality of information presented. Prosecutors raised questions about Busfield’s compliance history, referencing an unrelated professional matter and delays following the issuance of a warrant. Despite those concerns, the court concluded that structured supervision and clear conditions were sufficient to address potential risks while the case proceeds.

Court records also indicate that Busfield recently completed a psychological evaluation, which assessed him as a low risk. The judge reviewed multiple letters of support from family members and colleagues, including a statement from Gilbert describing her husband as dependable and supportive. Busfield has denied the allegations and has stated his intention to contest the charges through the legal process. The case will continue to unfold in New Mexico courts as further proceedings are scheduled.
